1. General provisions
1.1. These Terms and Conditions set out the rules for using the online store operating at auradynart.com under the AuraDynArt brand, and the rules for concluding distance sales contracts through it.
1.2. The store is operated by Cukiernia AleTort Jarosław Dyniewicz, a sole proprietorship registered in Poland, with its registered address at ul. Dwernickiego 22/U2, 04-391 Warsaw, Poland, tax identification number (NIP) 8211056131, entered in the Polish Central Register and Information on Economic Activity (CEIDG). Referred to below as the “Seller”, “we” or “us”.
1.3. You can contact us about anything — orders, complaints, cancellations or general questions — at auradynart@gmail.com. Postal address for correspondence: ul. Dwernickiego 22/U2, 04-391 Warsaw, Poland.
1.4. These Terms are permanently available on the store website in a form that allows you to download, save and print them.
1.5. The language of the contract is English. These Terms are governed by Polish law, as set out in section 13.
2. Definitions
- Seller — the business identified in section 1.2.
- Store — the AuraDynArt online store at auradynart.com.
- Customer — any natural person, legal person or organisational unit making a purchase in the Store.
- Consumer — a Customer who is a natural person making a purchase for purposes not directly related to their business or professional activity.
- Product — an item offered in the Store, in particular an art print (poster, wall art) manufactured to order using print-on-demand technology.
- Made-to-order Product — a non-prefabricated Product manufactured only after an Order has been placed and paid for, according to the specification chosen by the Customer (artwork, size, paper type).
- Order — the Customer’s declaration of intent leading to the conclusion of a sales contract.
3. Technical requirements
To use the Store you need a device with internet access, a current web browser with JavaScript and cookies enabled, and an active email address.
4. The nature of our products
4.1. All Products in the Store are manufactured to order using print-on-demand technology. Production begins once your payment has been received. We do not hold a stock of finished Products.
4.2. Because every item is produced individually, our Products are Made-to-order Products as defined in section 2. This matters for the right of withdrawal, which is explained in section 8.
4.3. Product images and room mock-ups shown in the Store are for illustration only. Slight differences in colour shade may occur, resulting from your screen calibration and from the nature of the printing process, along with a dimensional tolerance of up to 2 mm.
4.4. Frames, mounts, furniture and decorative items visible in mock-up images are not included unless the Product description explicitly states otherwise. What you buy is the print itself.
5. Placing an order
5.1. You place an Order by adding Products to the cart, choosing the variant (size, paper type), entering your delivery details, selecting a delivery and payment method, and confirming the Order with the checkout button.
5.2. Placing an Order requires that you read and accept these Terms.
5.3. The sales contract is concluded when we confirm acceptance of your Order by email to the address you provided.
5.4. You may order either with a registered account or as a guest.
5.5. You are responsible for the accuracy of the details you provide, in particular the delivery address and the Product variant selected. Because production starts quickly, please check your order confirmation and contact us immediately if anything is wrong.
6. Prices and payment
6.1. Prices are shown in US dollars (USD) and include any taxes due. Prices do not include delivery costs, which are shown separately before you place your Order.
6.2. We accept payment by credit and debit card and, depending on your country, Bancontact, EPS, iDEAL and Multibanco.
6.3. Payments are processed by WooPayments. We do not store full payment card details.
6.4. On your bank or card statement the charge may appear as ALETORT JAROSAW DYNIEW, which is the registered billing name of the Seller. If you do not recognise a charge, please email us at auradynart@gmail.com before filing a dispute with your bank — we will resolve it far faster.
6.5. If payment is not received within 7 days of the Order being placed, we may cancel the Order.
6.6. Proof of purchase (invoice or receipt) is issued electronically and sent to the email address you provided.
7. Production and delivery
7.1. Products are printed by production partners in the Gelato network, wherever possible at the print facility closest to your delivery address — within the European Union, the United States or the United Kingdom. This shortens delivery times and reduces transport emissions.
7.2. Total delivery time consists of production time, usually 2–5 business days, plus carrier transit time, usually 3–8 business days. These timeframes are estimates and run from the moment payment is received.
7.3. Delivery is carried out by carriers working with our Gelato print partners and appropriate for the destination country (postal operators and courier companies). You will receive a tracking number where the carrier provides one.
7.4. Delivery costs are borne by the Customer unless a free shipping promotion applies. The delivery cost is always shown before you place your Order.
7.5. For deliveries outside the customs territory of the European Union, you may be charged customs duties, import taxes or handling fees under the law of the destination country. These charges are not included in the Product price or delivery cost and are payable by you.
7.6. If a parcel is returned to the print facility because of an incorrect or incomplete address provided by you, we can send it again once you have covered the cost of the second shipment.
8. Right of withdrawal (cancellation)
8.1. Under Article 16(c) of Directive 2011/83/EU on consumer rights, implemented in Poland by Article 38(3) of the Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or are clearly personalised.
8.2. Every Product in this Store is a Made-to-order Product as defined in section 2 — printed individually only after your Order is placed, in the size and on the paper you selected. The exclusion in 8.1 therefore applies, and we are unable to accept returns simply because you have changed your mind.
8.3. This information is given to you before you place your Order, through your acceptance of these Terms at checkout.
8.4. This exclusion does not limit your rights in any way where a Product is faulty, damaged in transit, not as described, or where we have made a mistake. Those situations are covered by section 9, and in those cases you are fully protected.
8.5. Further practical detail is set out on our Refund and returns policy page.
9. Faulty products, damage and complaints
9.1. We are liable to Consumers for any lack of conformity of the Product with the contract, in accordance with applicable consumer protection law.
9.2. To make a complaint, email auradynart@gmail.com with your order number, a description of the problem and, for damage or print defects, photographs of the Product and of the packaging.
9.3. We will review your complaint within 14 days of receiving it and inform you of the outcome by email.
9.4. Please report transit damage or print defects within 14 days of receiving the parcel. We recommend keeping the packaging until your claim is resolved.
9.5. Where a complaint is justified, we will reprint and reship the Product at our own cost, or refund the purchase price together with the delivery charge — your choice.
9.6. Please do not send a Product back before contacting us. In most cases photographs are all we need, and returning the print is unnecessary and slows things down.
10. Intellectual property
10.1. All artwork, designs, descriptions and photographs presented in the Store are protected by law and are either owned by the Seller or used by the Seller under the appropriate rights.
10.2. Purchasing a Product does not transfer copyright or grant any licence to use the artwork. The Product is intended solely for your private, non-commercial use.
10.3. Copying, scanning, reproducing, publicly distributing, reselling or any commercial use of the artwork is prohibited without our prior written consent.
11. Personal data
11.1. The controller of Customers’ personal data is the Seller identified in section 1.2.
11.2. We process your data in order to fulfil your Order, process payment, arrange delivery (which includes passing your address to the print facility and the carrier), handle complaints, and meet our tax and accounting obligations.
11.3. Providing your data is voluntary but necessary to conclude and perform the sales contract.
11.4. Full details of how we process personal data, including your rights under the GDPR, are set out in our Privacy Policy.
12. Out-of-court dispute resolution
Consumers may use out-of-court complaint and redress procedures. In Poland these include mediation before the regional inspector of the Trade Inspection (Inspekcja Handlowa) and assistance from a district or municipal consumer ombudsman; information is published by the Polish Office of Competition and Consumer Protection (UOKiK). Consumers resident in other countries may also use the consumer dispute bodies available to them locally. Using these procedures is voluntary and does not affect your right to bring court proceedings.
13. Final provisions
13.1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. This choice of law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
13.2. We may amend these Terms. Orders placed before an amendment takes effect are governed by the version of the Terms in force on the date the Order was placed.
13.3. These Terms are effective from 12 August 2026.
